Re “Searching
for Elena Kagan” (editorial, May 11):
You seem to worry that it isn’t sufficiently clear whether Elena Kagan,
by all accounts a distinguished legal scholar, would move to enact each
and every one of your policy preferences from the bench.
Your anxiety gives me hope that she may “grow” and “evolve” into the
kind of judge who tries her dispassionate best to determine whether the
Constitution clearly removes a particular issue from the political
process, and if not leaves its resolution to the voters.
