The editorial board of the New York Times weighs in on the constitutionality of the individual mandate of Obamacare. It quotes two law professors, one a progressive (Walter Dellinger) and the other a libertarian (Randy Barnett). Guess which one gets bad motives imputed to him? Guess which one is said to have a hidden agenda? Two can play this stupid game. Dellinger, qua progressive, wants expansive, intrusive government. To achieve this, he interprets the Commerce Clause so that it allows Congress to do pretty much anything it desires. The dishonesty of the editorial board is breathtaking. I read its opinions not because I learn anything from them, but only to see how far progressives will go to impose their values on the American people.
