Here is a review of Richard Posner's latest book. I don't always agree with Judge Posner, but I always enjoy reading him. In case you don't know it, Posner is the founder (or one of the founders) of the law-and-economics movement, which, in its positive (as opposed to its normative) branch, seeks to explain legal phenomena (such as judicial decisions) in economic terms. In other words, there is an implicit economic logic to the law, especially the common law of property, contract, and tort. Posner's treatise Economic Analysis of Law, which was published in 1972, when Posner was 33 years old, is now in its seventh edition. Posner is 70 years old, but shows no signs of slowing the pace of his scholarly activity. He is still a full-time federal appellate judge.
