The intellectual dishonesty of the New York Times editorial board goes all the way down. Read this. When the United States Supreme Court issues a ruling that the board dislikes, the board accuses the Court of basing its ruling on "a legal technicality." Think about it. The board is always on the side of justice; therefore, if it disagrees with the Court, the Court must be resorting to trickery to do injustice.
Addendum: According to the editorial board's logic, all of the following doctrines constitute "legal technicalities": mootness; standing; and ripeness.
